1. About Us and These Terms

Dual Control Car Market (dualcontrolcarmarket.co.uk) (“the Site”, “we”, “us”) is contactable at info@dualcontrolcarmarket.co.uk.

These Terms and Conditions (“Terms”) govern your use of the Site. By creating an account, submitting a Listing, or making an enquiry, you agree to these Terms. If you don’t agree, please don’t use the Site.

2. Definitions

  • “the Site” means dualcontrolcarmarket.co.uk and any related services we provide.
  • “Listing” means any item advertised for sale on the Site, including but not limited to vehicles, dual control pedals, and other driving instructor equipment we may allow in future.
  • “Seller” means a user who submits a Listing.
  • “Buyer” means a user who enquires about or purchases a Listing.
  • “User” means anyone who uses the Site, whether registered or not.

3. What the Site Is

The Site is a classifieds platform connecting Sellers and Buyers of driving-instructor-related items, currently including dual control vehicles, with further categories of Listing possibly added in future.

We are not a dealer, broker, or agent. We do not buy, sell, own, inspect, or take possession of anything listed on the Site, and we are not a party to any sale, purchase, or agreement made between Users.

4. Accounts

  • You need a free account to submit a Listing. You don’t need an account to browse Listings or submit an enquiry.
  • You must be 18 or over and provide accurate information when registering.
  • You’re responsible for keeping your login details secure and for all activity under your account.
  • One account per person or business. Creating multiple accounts to get around the listing limit below, or to disguise trade or dealer activity as private selling, is not allowed and may result in your account and Listings being removed without notice.

5. Listing an Item

  • Listing an item is currently free.
  • Each account may have a maximum of 2 active Listings at any one time. This limit exists to keep the Site for individual instructors, rather than dealers or trade sellers listing stock. We may introduce a separate paid plan for dealers or higher-volume sellers in future; this won’t change the free limit for individual sellers.
  • By submitting a Listing, you confirm that:
  • you own the item, or have the owner’s express permission to sell it, and have full legal authority to do so;
  • you hold all documentation, licences, and paperwork required to sell it legally;
  • the item is, to the best of your knowledge, legal to sell and free of any undisclosed defect that would make it unsafe or unfit for its intended use — for vehicles specifically, this includes being roadworthy and holding a valid MOT where legally required;
  • the information, description, and photos you provide are accurate, complete, and not misleading; and
  • listing the item does not breach any law, regulation, or third party’s rights.
  • We review Listings before they go live and may reject or remove a Listing, at our discretion, if it breaches these Terms, appears fraudulent, inaccurate, or misleading, or is otherwise inappropriate.
  • It’s your responsibility to mark a Listing as sold or remove it once the item is no longer available.

6. Enquiring About a Listing

  • If you’re interested in a Listing, you can submit an enquiry through the form on that Listing.
  • Submitting an enquiry sends your contact details and message directly to the Seller. From that point, all further communication, negotiation, viewing, payment, and transfer happens directly between you and the Seller, entirely outside the Site.

7. Our Role and Limitation of Liability for Transactions

This is the section that matters most, so we’ve made it as clear as we can.

We are not a party to, and accept no responsibility or liability for, any transaction, agreement, or dispute between a Buyer and a Seller. We do not verify the accuracy of any Listing, inspect any item, run background or identity checks on Users, or guarantee that any Seller will deliver what they’ve listed or that any Buyer’s payment is genuine or will be honoured.

Using the Site to buy or sell means dealing directly with another member of the public. We strongly encourage every User to use the same common sense and good judgment they would use responding to any classified advert — verify what you’re buying in person wherever possible, be cautious with anyone who pressures you to act quickly or unusually, and never send money or personal financial details to someone you haven’t verified in person. 8. Private Sales and Your Consumer Rights

If you buy privately rather than from a registered trader, please be aware that UK consumer protections such as the Consumer Rights Act 2015 generally apply to purchases from a business, not to private, person-to-person sales — so the usual rights to reject faulty goods or expect a repair or refund from a business will not normally apply. This is a feature of UK law generally, not something specific to this Site, but it’s worth understanding before you buy or sell.

9. Driving Instructor Services Directory

  • We may separately list driving-instructor-related businesses and services on the Site, for informational purposes.
  • Businesses appear in this directory only where we’ve arranged this with them directly; this directory is not a self-serve or automated submission system.
  • Listing a business does not imply that we endorse, recommend, vet, or guarantee that business or its services in any way.
  • Any agreement you enter into with a business listed in this directory is between you and that business directly. We are not a party to it and are not responsible for the quality, safety, or outcome of any service provided.

10. Marketing Communications

  • We will only send you marketing emails if you’ve actively opted in via the separate consent option at registration — this is never a condition of creating an account or listing an item.
  • You can unsubscribe from marketing emails at any time. See our Privacy Policy for more detail on how we handle your data.

11. Acceptable Use

You agree not to:

  • List an item you don’t own, or don’t have full permission and authority to sell;
  • Post false, misleading, or fraudulent information about yourself or any Listing;
  • Use multiple accounts to get around the 2-Listing limit;
  • Use the Site for trade, dealer, or bulk-selling activity without our agreement, or disguise such activity as a private sale;
  • Scrape, copy, or republish Listings or Site content elsewhere;
  • Use the Site to send spam, unsolicited marketing, or abusive messages to other Users.

We may suspend or remove any account, Listing, or content that breaches these Terms, without notice.

12. Intellectual Property

The Site’s design, branding, and content (excluding content submitted by Users, such as Listing photos and descriptions) belongs to us. You keep ownership of content you submit, but by submitting it you give us a licence to display it on the Site.

13. Liability

  • The Site is provided “as is.” We don’t guarantee it will be available at all times or free of errors.
  • To the fullest extent permitted by law, we’re not liable for any loss or damage arising from: a transaction between a Buyer and Seller; the condition, accuracy, safety, or legality of any Listing; or your dealings with a business listed in the Services directory.
  • You agree to indemnify us against any claim, loss, or expense arising from your use of the Site, your Listing, or your breach of these Terms.
  • Nothing in these Terms limits our liability for anything that can’t legally be limited or excluded, such as death or personal injury caused by our negligence, or fraud.

14. Changes to These Terms

We may update these Terms from time to time. Continuing to use the Site after changes are posted means you accept the updated Terms.

15. Severability

If any part of these Terms is found to be unenforceable, the rest of these Terms will remain in full effect.

16. Governing Law

These Terms are governed by the laws of England and Wales, and any disputes will be handled by the courts of England and Wales.
